Introduction and effectiveness of the General Conditions

1. These general conditions of sale (hereinafter, "General Conditions") have as their object the discipline of purchasing products and services, carried out remotely and made available, via the internet, from the site https://youmooda.com (hereinafter, the "Site") in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (later,“Consumer Code”).

2. The seller of the products and owner of the Site is: MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC with registered office in Casale Monferrato (AL), Via Roma n. 77/79, C.F / P.I. and registration at the Alessandria Company Register 01534710064 REA: AL167831 - E-mail address: info@youmooda.com.

3. The consumer who accesses the Site to make purchases (hereinafter " Customer ") is required, before sending the order, to carefully read these General Conditions, that have been made available to him on the Site and which will be available at any time by the Customer also through the link contained in the confirmation email of each order to allow it to be reproduced and stored.

4. The Customer is strictly prohibited from providing false and / or fictional data in the registration procedure necessary to activate the procedure for the execution of this sales agreement and the related further communications; personal data and e-mail address must be exclusively real personal data. In the case of orders placed through the website https://youmooda.com, the information contained in the General Conditions must be viewed and accepted by the Customer before sending the purchase order. Acceptance will take place by marking the appropriate space on the site. Without this, the order cannot be executed.

5. In case that the person making purchases on the Site requests an invoice and / or in any case is not a "consumer or user" as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the right of withdrawal will not be applied, as the Consumer Code apply only to "consumers".

6. The contracts concluded with MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is English.

Choose and order the Products

1. The characteristics and the price of the various products on sale on the Site (hereinafter " Product " or " Products ") are shown on the page relating to each Product.

2. To purchase the Products, the Customer must fill in and send the order form in electronic format, following the instructions on the Site. The Customer must add the Product to the "Cart" and, after having read the General Conditions and the Policy Privacy and confirmed their acceptance, he/she must enter the shipping and billing information, select the desired payment method and confirm the order.

3. By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.

4. The contract between MY WAY DI BRUNELLO BIAGIO and CALVARUSO STEFANO SNC and the Customer must be considered concluded with the acceptance of the order by MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC. This acceptance is communicated to the Customer via an e-mail containing references to these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation email and if he/she detects errors in the order he/she will have time until the courier takes charge of the goods to contact Customer Service directly from the Site using the appropriate contact form accessible via the "Contact us" link or by phone at no. (+39) 393 907 5377. After this deadline, changes will no longer be accepted, without prejudice to the Customer's rights referred to in article 7 below.

5. Once the order has been received, MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC will check the availability of the stocks for the order fulfillment. In the event that one or more Products are not available, the MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC Customer Service will promptly send an email to the Customer who, within the following 24 hours, will have the right to reply to confirm the shipment of any more Products available or cancel it. If there is no response within this period, the order will be considered canceled.

IProduct information

1. The information and characteristics related to the Products are available, with the relative Product codes, on the Site.

2. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of difference between the image and the written product sheet, the description of the product page always prevails.

Prices and shipments

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros.

Methods of payment and invoicing

1. Terms of payment for those who place a direct order will be: Credit card, PayPal, cash on delivery (Italy only) and, on request, bank transfer. MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC reserves the right to take the appropriate actions for the collection of the credit, including giving proxy to specialized companies for the procedure, charging interest on arrears, charging legal fees and/or varying the conditions of payment. It is understood that the delivery of the products will be subject to payment by the Customer of the relative price in the manner made available by MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC. In case of a bank transfer, the shipment of the order is subject to the actual receipt of the transfer.

Shipping and delivery

1. The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the "Shipping Data" field.

2. All purchases will be delivered by express courier (hereinafter, " Courier ") from Monday to Friday , excluding holidays and national holidays. MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC is not responsible for delays that are not foreseeable or not attributable to it.

3. Once the Products have been shipped, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment.

4. In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a term of 7 (seven) working days from the day following that on which MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC has confirmed the order to the Customer by means of a specific order confirmation email. The aforementioned term of 7 working days applies for shipments in Italy and abroad to European countries. In countries where customs clearance is required, the 7-day deadline may be increased.

5. In Italy the delivery service via DHL is active. The service includes 2 delivery attempts at the address indicated when ordering. However, a notice of attempted delivery will be left with instructions on how to contact the courier and organize the return. In any case, the Customer has the responsibility to inquire with DHL about any updates or changes to the delivery procedure described above.

Right of withdrawal

1. Refund or free replacement of defective products or products that do not correspond to the requests is guaranteed (subject to authorization by the office in charge). No complaints can be considered later than 10 days upon receipt of the goods and if the material will not be returned in the original packaging. If these requirements are no longer met, the goods will be returned to the sender carriage forward. However, it is understood that the guarantee on the products can only be that offered by the Manufacturers, by not assuming MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC any additional liability. Pursuant to the D.P.R. n. 472 of 14/08/96, the returned material must necessarily be accompanied by a transport document containing the number and date of the document relating to the disputed product. Although not expressly provided for in these general conditions, the provisions of the Civil Code will apply. MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC, reserves the right to make any changes to the original commercial proposal without any commitment or notice.

2. The Customer and / or the person in charge of the same at the collection of the goods will be required to check, at the time of delivery and in presence of the carrier, the integrity of the delivered packages and the relative number, reporting in writing any discrepancies in the number and / or integrity of packages in the special space reserved in the transport document (DDT) which duly signed will remain with the carrier. Once this is done, the Customer must contact MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC to report any problems within 10 days of delivery.

3. The right of withdrawal is governed by the following conditions:

• The law applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the right of withdrawal only on part of the Product purchased.

• In case of exercise of the right of withdrawal MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC will refund the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the right of MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of payment by cash on delivery, the processing times of the refund procedure may exceed 14 days, based on the receipt of the aforementioned payment by the Courier.

• Also in order to guarantee free return, Products must be returned in the same box in which they were received, if still usable, or in a box of the same size, if the original packaging could not guarantee the integrity of the returned product.

• The right of withdrawal will not apply to the following cases, pursuant to art. 59 Legislative Decree 21/2014: order of Products made to measure or clearly personalized; order of Products that are likely to deteriorate or expire rapidly; order of sealed Products that are not suitable for return for hygienic reasons or related to health protection or that have been opened after delivery.

1. With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that "risk to deteriorate or expire rapidly" include both all Food products (including wines, spirits and drinks) and cosmetics , as the characteristics and qualities of these types of Products are subject to alteration also as a consequence of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is applicable only for the Products purchased on the Site that can be returned to MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC and put back on the market without endangering the health of consumers.

• In cases of exclusion of the right of withdrawal, MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC will return the purchased Products to the Customer, charging the shipping costs to the same.

Free return in case of exercise of the right of withdrawal

1. As a most favorable condition for the customer, MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC fully bears the shipping costs for returning the Products in the event of exercising the right of withdrawal.

2. In order to benefit from this free shipping, the Customer who intends to exercise the right of withdrawal must follow the procedure indicated in the previous article " Right of withdrawal " and wait to be contacted by MY WAY DI BRUNELLO BIAGIO E CALVARUSO STEFANO SNC to arrange the return of the Products to the courier.

3. The return is free, except for the items on sale or in promotion. For these items, a deduction is applied to the amount returned equal to the cost of shipping (€ 8).

Warranty and defects of conformity

2. The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. Errors and limitations of liability

Except for willful misconduct or gross negligence, any Customer's right to compensation for damages or the recognition of compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and / or things, caused by non-acceptance or evasion, even partial , of an order.

4. MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC promotes the responsible consumption of alcohol and excludes any liability, except for willful misconduct or gross negligence, in the case of purchases made by children under 16 years of age.

Applicable law and competent court

1. The sales contract between the Customer and MY WAY DI BRUNELLO BIAGIO AND CALVARUSO STEFANO SNC is understood to be concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this contract of distance selling, the territorial jurisdiction will be exclusively that of the Court of Vercelli.
